Welcome to Dreams Dept. These Terms and Conditions (“Terms”) govern your use of the Dreams Dept website located at dreamsdept.com (the “Site”), operated by Theory Dept Pty Ltd, trading as Dreams Dept (“we,” “our,” or “us”).

By accessing or using our Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not access or use the Site.

1. Use of the Site

You agree to use the Site in compliance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

2. Services

Dreams Dept builds systems for studios and other service businesses. Each system runs one of the business’s repeated delivery processes, built from the way that business already does the work. We also provide scoping, consulting, and related services, along with free and paid resources.

The scope, price, deliverables, timeline, and payment schedule of any engagement are set out in a separate proposal or service agreement. Where that agreement differs from these Terms, the agreement applies.

Systems we build may run on third-party software and platforms. Their availability and terms are set by their providers and are outside our control.

3. Payments and Refunds

All payments are processed securely through Stripe. Prices are quoted in the currency shown on your proposal or invoice. Payment terms, including any deposit or recurring monthly payments, are set out in your service agreement.

Digital products and downloadable resources are non-refundable once delivered or accessed, except where the Australian Consumer Law requires otherwise. Refund terms for service engagements are set out in your service agreement.

4. Intellectual Property

All content, trademarks, logos, designs, images, and other intellectual property displayed on the Site are owned or licensed by Theory Dept Pty Ltd and protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, distribute, or exploit any content without prior written permission.

For systems we build and other service engagements, ownership and licensing are set out in your service agreement.

5. User Contributions

If you submit content to the Site, such as testimonials, feedback, or other materials, you grant Dreams Dept a non-exclusive, royalty-free, perpetual licence to use, display, edit, modify, and distribute such content for the purposes of marketing, promotion, and service improvement.

6. Tools, Estimates, and Results

The Site and our resources may include interactive tools, estimates, and worked examples, including calculations based on figures you give us. These are provided for general information only and do not constitute financial, legal, or business advice, guarantees, or promises of specific outcomes. Results depend on the inputs used and should not be relied upon as projections of revenue, time saved, or business performance.

Client results described on the Site are specific to those clients and their circumstances. They are not a promise that you will achieve the same results.

7. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Dreams Dept makes no warranty regarding the accuracy, completeness, or reliability of the Site’s content or services.

8. Limitation of Liability

To the maximum extent permitted by law, Theory Dept Pty Ltd shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your access to or use of the Site, or inability to use the Site.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

9. Indemnification

You agree to indemnify and hold harmless Theory Dept Pty Ltd, its affiliates, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Site or violation of these Terms.

10. Third-Party Links

Our Site may contain links to external third-party websites. We are not responsible for the content or practices of these sites, and their inclusion does not imply endorsement.

11. Termination

Dreams Dept reserves the right, at its sole discretion, to terminate or suspend your access to the Site without notice for any reason, including breach of these Terms.

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
